General Firoz Khan has filed an urgent application in the Johannesburg High Court, seeking to stop the South African Police Service (SAPS) from allegedly downloading, copying, disseminating or conducting forensic examinations on data from devices seized from him.
In court papers, Khan is asking the court to interdict SAPS from accessing information stored on his cellphone devices and laptops, pending legal proceedings.
He is also seeking an order compelling police to return all seized cellphone devices and laptops to him.
In addition, Khan wants the court to declare what he describes as a “warrantless search” conducted by SAPS members at his residence in Houghton, Johannesburg, unlawful and unconstitutional.
The urgent court application is expected to place the spotlight on the legality of the police operation, particularly whether SAPS acted within the law when allegedly searching his home and seizing electronic devices without a warrant.
