Busisiwe Mkhwebane Says She’s “Vindicated” After Phala Phala ConCourt Judgment

Former Public Protector Adv. Busisiwe Mkhwebane has broken her silence following the Constitutional Court’s judgment on the Phala Phala matter, saying she feels vindicated after years of legal battles.

In a post on X, Mkhwebane claimed the ruling confirmed she was unlawfully removed from office by President Cyril Ramaphosa and the Democratic Alliance for simply upholding the law and the Constitution.

“I have once again been vindicated. I was unlawfully removed by President Ramaphosa and the DA for following the law and country’s constitution. God came through for me after the pain they all put me through for years,” she wrote.

Mkhwebane has long maintained that her investigation into the Phala Phala farm robbery and her subsequent impeachment were politically motivated. Her removal was confirmed by Parliament in 2023 after an inquiry found her guilty of misconduct and incompetence.

The Constitutional Court’s recent judgment relates to the EFF’s challenge against Parliament’s decision not to proceed with Section 89 impeachment proceedings against President Ramaphosa. While the court did not rule directly on Mkhwebane’s removal, she says the outcome supports her stance that her office was undermined for doing its constitutional duty.

There has been no official response yet from the Presidency or the DA to Mkhwebane’s latest remarks.
