Suspended EMPD Deputy Chief Julius Mkhwanazi and his co-accused are back in the Brakpan Magistrate’s Court today as their bail application continues in connection with the alleged murder of businessman Emmanuel Mbense.
Mkhwanazi is already out on bail in three other criminal matters, making this his fourth bail application.
The accused are facing charges linked to the 2022 abduction and murder of Mbense, with the State opposing their release on bail.
The murder charge falls under Schedule 6 of the Criminal Procedure Act. This means the accused must convince the court that exceptional circumstances exist that justify granting bail.
The defence and prosecution are expected to continue presenting their arguments before the court makes a decision.
Mkhwanazi and his co-accused remain presumed innocent until proven guilty.
The big question today is whether the suspended metro police boss will secure bail for a fourth time.
