Dr Nandipha Tells Constitutional Court Her Return From Tanzania Was Unlawful

Lawyers representing Nandipha Magudumana have argued before the Constitutional Court of South Africa that her return to South Africa from Tanzania after fleeing with convicted rapist and murderer Thabo Bester was unlawful.

During proceedings at the Constitutional Court, Magudumana’s legal team argued that she was effectively abducted and unlawfully deported from Tanzania in 2023, claiming proper extradition procedures were not followed when South African authorities secured her return.

Her lawyers contend that because the process used to bring her back to South Africa was allegedly unlawful, the legal proceedings against her should be questioned.

The State, however, has maintained that Magudumana returned lawfully and has consistently opposed her arguments, insisting that the criminal case against her should continue.

Magudumana faces multiple charges linked to Bester’s dramatic escape from the Mangaung Correctional Centre in 2022, including allegations of fraud, corruption and assisting an escape.

The case continues to attract national attention, with the Constitutional Court expected to determine whether the circumstances surrounding her return to South Africa had any legal implications for her prosecution.
